These Terms govern your use of Staked (“Staked”, “we”, “us”). By creating an account, joining the waitlist, or entering a cycle, you agree to these Terms. If you do not agree, do not use the service. Contact: [email protected].

Staked is an accountability tool, not a gambling product. You set a personal running target and back it with your own money, then earn that money back by completing your runs. There is no pool, no prize, no house edge and no game of chance, and you can never receive more than you put in.

Staked sets you a personalised monthly running target derived from your own Strava history. You back it with your own money, held as a refundable stake. Your stake is divided across the runs in your target: each qualifying run returns its slice to you, and completing your target returns the whole stake. Any slice you neither complete nor cover with a pass is forfeited, with 80% donated to a nominated charity and 20% retained by Staked. Staked never pools or redistributes money between users, and you can never receive more than your own stake back.

3.Strava

Strava is the sole and final source of truth for verifying your activity. You must connect Strava and grant read access to your activities. You must not falsify, spoof, edit, or otherwise manipulate activity data. We may request additional proof of an activity from any account we flag for review, and may withhold results or payouts pending that review.

Payments are processed by Stripe. Your stake and fee are charged immediately at enrollment; we do not place a temporary “hold”. Supported currencies include USD, EUR, AUD and NZD. International or foreign-currency cards may incur higher processing costs, which may be passed on to you. By enrolling you authorise the charge.

7.Refunds & cancellation

You may withdraw before a cycle begins. Once a cycle has started, your net stake is committed and there are no mid-cycle refunds except for a verified injury or medical reason (see section 8). The $5 platform fee is non-refundable once charged. Nothing here limits rights you cannot waive under applicable consumer law (see section 12).

If you are genuinely injured or unwell and cannot complete a cycle, contact [email protected]. We review these manually and may ask for reasonable evidence, which may include:

Approved cases may receive a refund of the net stake or a cycle pause, at our reasonable discretion. Using an injury claim to avoid a target you would otherwise miss is treated as a breach of fair play (section 10).

9.Losing Strava access

If you disconnect Strava, revoke our access, or we otherwise lose the ability to verify your activity during a cycle, and access is not restored before cycle close, we cannot confirm the affected runs and any portion of your stake you have not already earned back is forfeited.

We operate a zero-tolerance policy. Prohibited conduct includes:

Where we reasonably determine, based on Strava data and review, that you have breached fair play, we may remove you, forfeit your stake, and ban you. Our decision is final.

11.Chargebacks

If you dispute a properly-charged transaction with your bank or card provider, any resulting fees or costs may be passed on to you, and we may suspend or close your account. Please use our complaints process (section 12) before initiating a chargeback.

12.Complaints

If something goes wrong, contact [email protected] and we will aim to respond promptly. Nothing in these Terms excludes or limits any rights or guarantees you have that cannot be excluded under the New Zealand Fair Trading Act 1986 and Consumer Guarantees Act 1993, the Australian Consumer Law, applicable European Union consumer law, or the consumer-protection laws of your jurisdiction.

Only stake what you can comfortably afford. Staked is a motivation and accountability tool, not an investment and not financial advice. Always train and run safely and within your own limits.

14.Changes & termination

We may update the target configuration, fees (with reasonable notice), or these Terms from time to time. We may suspend or terminate accounts that breach these Terms. Material changes will be communicated before they take effect.

15.Liability

To the fullest extent permitted by law, and without limiting any non-excludable consumer guarantees, Staked is not liable for indirect or consequential loss, or for losses arising from third-party services outside our control (including Strava or payment provider outages or delays).

16.Governing law

These Terms are governed by the laws of New Zealand, without prejudice to mandatory consumer protections in your country of residence. The applicable law and forum for users in other markets may be confirmed for those markets before launch there.
